An asylum application is deemed to be manifestly unfounded when Ofpra considers that the facts relied on clearly cannot reflect the criteria stipulated by the Geneva Convention or the criteria justifying the granting of subsidiary protection.
These are asylum seekers under 18 years of age who are not accompanied by their father or mother and, in addition, are not under the responsibility of any adult authorised to represent them. A minor cannot initiate administrative procedures directly, and must therefore be assigned a legal representative. Accordingly, since the Act of 4 March 2002 on parental authority, the competent Public Prosecutor must assign an ad hoc administrator to any child with no legal representative, who shall submit an asylum application on French territory.
